Le Pain Quotidien has updated its privacy policy (“Policy”)  to describe how it collects, uses, and shares personal information with respect to information collected from the in-store WiFi, online website located at www.lepainquotidien.com (the “Website”) and the mobile application (the “Mobile App”).

This Policy applies to the WiFi, Website, the Mobile App, and any other websites owned and operated by Le Pain Quotidien that direct the viewer or user to this Policy.  In this Policy, the terms “Le Pain Quotidien,” “we,” and “us” refers to Le Pain Quotidien.

Your use of the WiFi, Website or Mobile App constitutes your acceptance of this Policy and your consent to the practices it describes.

The Information Le Pain Quotidien Collects

Le Pain Quotidien obtains personally identifiable information such as your name, email address and payment card or other information when you provide it voluntarily (such as date of birth). We collect information you share, post or provide on the WiFi, Website or the Mobile App.  Additionally we collect information about your order, including the items purchased, the payment method and your billing information.

In addition to personally identifiable information, Le Pain Quotidien collects aggregated data or anonymized data that does not directly identify you. Email If you receive email from us, we use certain tools to capture data related to when you open our message, click on any links or banners it contains and make purchases. We have a legitimate interest in understanding how you interact with our communications to you.
Employment If you apply for a job posting, or become an employee, we will collect personal information necessary to process your application. This includes, among other things, your Social Security Number. We use information about current employees to perform our contract of employment, or the anticipation of a contract of employment with you.  In some contexts, we are also required by law to collect information about our employees.  We also have a legitimate interest in using your information to have efficient staffing and work force operations.
Feedback/Support If you provide us feedback or contact us for support we will collect your name and e-mail address and possibly other personal information, as well as any other content that you send to us in order to reply. We have a legitimate interest in receiving, and acting upon, your feedback or issues.
Mailing List When you sign up for one of our mailing lists we will collect your email address or postal address. We have a legitimate interest in sharing information about our products or services.
Mobile Devices We may collect information from your mobile device such as unique identifying information broadcast from your device when visiting our website or when visiting one of our stores. We have a legitimate interest in identifying unique visitors, and in understanding how users interact with us on their mobile devices.
Order Placement We collect your name, billing address, e-mail address, phone number, and payment card information when you place an order. We use your information to perform our contract to provide you with products or services.
Surveys When you participate in a survey we may collect additional information that you provide through the survey. If the survey is provided by a third party service provider, the third party’s privacy policy applies to the collection, use, and disclosure of your information. We have a legitimate interest in understanding your opinions, and collecting information relevant to our organization.
Third Party Tracking We participate in behavior-based advertising. Web logs We collect information from you, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet), domain name, click-activity, referring website, and/or a date/time stamp for your visit. In addition to information stored by our servers, we may also use cookies and clear GIFs. Cookies may be removed by following instructions provided by your browser. We have a legitimate interest in monitoring our networks and the visitors to our websites.  Among other things, it helps us understand which of our services is the most popular.
Cookies We use cookies. “Cookies” are small pieces of information that a website sends to your device while you are viewing a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your device until you delete them). Cookies and browser storage allow us to recognize your computer while you are on our Wi-Fi, Website and the Mobile App and help customize your online experience and make it more convenient for you. If you disable cookies or other device tracking features, however, you may not be able to use certain personalized functions of the WiFi, Website or the Mobile App. We have a legitimate interest in making our website operate efficiently.

In addition to the information that we collect from you directly, we may also receive information about you from other sources, including third parties, business partners, our affiliates, or publicly available sources.

Use and Processing of Information

In addition to the uses described above, Le Pain Quotidien may use information about you in the following ways

  • Process and fulfill your in-store and Mobile App orders

  • Conduct research and help us learn more about your preferences and enhance your experience

Although the sections above describe our primary purpose in collecting your information, in many situations we have more than one purpose.  For example, if you complete a Mobile App order we may collect your information to perform our contract with you, but we also collect your information as we have a legitimate interest in maintaining your information after your transaction is complete so that we can quickly and easily respond to any questions about your order.  As a result, our collection and processing of your information is based in different contexts upon your consent, our need to perform a contract, our obligations under law, and/or our legitimate interest in conducting our business.

Sharing of Information

In addition to specific situations identified elsewhere in this policy Le Pain Quotidien only shares personal information in the following situations:

  • Affiliated companies, carefully selected vendors, business partners and other organizations to provide better service to you. These companies need information about you to perform their service function (such as to process and fulfill your order, verify your credit card information, and to protect you from fraud).
  • Specially chosen companies that help us with marketing functions (such as manage our Internet business, maintain and manage our customer information, as well as market our products and services).

Children’s Privacy

The Website and Mobile App are not directed toward and designed for use by persons under the aged of 16. Le Pain Quotidien will not approve applications of, or establish or maintain registrations for any child whom Le Pain Quotidien knows to be under the age of 16. Le Pain Quotidien does not solicit or knowingly collect personally identifiable information from children under the age of 16.

How We Protect Your Information

Le Pain Quotidien protects your information using reasonable technical, physical, and administrative security measures to reduce the risk of loss, misuse, unauthorized access, disclosure or modification of your information. Some of our safeguards include firewalls, data encryption, physical access controls, and administrative informational controls. When you transmit highly sensitive information (such as a credit card number) through the Website or in the Mobile App, we encrypt the transmission of that information. While we have employed reasonable and appropriate security technologies and procedures to assist safeguarding your personal information, no system or network can be guaranteed to be 100% secure. In the event that we are required by law to inform you of any unauthorized access to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

In some areas of the WiFi, Website or the Mobile App, we may provide a link to another website. Other websites, including social media sites, have their own policies regarding privacy and security, and these may vary from ours. We have no control over the privacy practices of websites or applications that we do not own.

Data Transfer to Third Parties

Your information may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. By submitting your personal information to us you agree to the transfer, storage and processing of your information in a country other than your country of residence including, but not necessarily limited to, the United States.

Your Rights

Right of Revocation

We rely on you to update and correct your personal information.  Our websites allow you to modify your account profile. Right to Blocking or Deletion

With respect to any legal obligations preventing us from deleting your personal information, your information will only made accessible for the purposes of compulsory legal regulations.

Online Tracking

We do not currently recognize automated browser signals regarding tracking mechanisms, which may include “Do Not Track” instructions.
